By accessing or using Ya Vkurse ("the Service", "the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Ya Vkurse is a SaaS fleet operations workspace platform that provides tools for managing truck and trailer fleet operations including department notes, pre-trip inspections (PTI), team communication, and audit logging. The Service is intended for fleet management companies, owner-operators, and transportation businesses.

3. User Accounts

To access the Service, you must create an account by providing your name and a valid email address. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring your account information is accurate and up to date

You may not create accounts using automated means or under false pretenses. One person may not maintain more than one active account.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others. You agree not to:

• Upload or transmit any content that is unlawful, harmful, threatening, abusive, or otherwise objectionable
• Attempt to gain unauthorized access to any part of the Service or its related systems
• Use the Service to transmit spam, phishing attempts, or malicious code
• Reverse engineer or attempt to extract the source code of the Service
• Use the Service to violate any applicable laws or regulations
• Share account credentials with unauthorized users

5. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

You retain ownership of all data and content you upload to the Service. By uploading content, you grant Ya Vkurse a limited license to store, process, and display that content solely for the purpose of providing the Service to you.

6. Subscription and Payment

Some features of the Service may require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by applicable law or as expressly stated in our refund policy.

We reserve the right to change subscription prices with 30 days' notice. Continued use of the Service after a price change constitutes your acceptance of the new pricing.

7. Termination

You may terminate your account at any time by contacting us at support@bevkurse.com. We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service immediately ceases.

We will retain your data for 30 days after account termination, after which it may be permanently deleted.

8. Disclaimers and Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, Ya Vkurse disclaims all warranties including merchantability, fitness for a particular purpose, and non-infringement.

Ya Vkurse shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid to us in the preceding 12 months.

9. Indemnification

You agree to defend, indemnify, and hold harmless Ya Vkurse and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by a prominent notice on the Service. Your continued use of the Service after such notice constitutes your acceptance of the modified Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.
